HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19865 OF 2011 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in taking objection to consider the Caste Certificate of the petitioner issued by the Revenue Divisional Officer, Kurnool regarding his status of Budaga Jangam (SC Category) for admission into Electronics and Communication Engineering Course as illegal and arbitrary and consequently to consider the candidature of the petitioner for admission into Electronics and Communication Engineering Course under SC category on the basis of the Caste Certificate issued to the petitioner by the Revenue Divisional Officer. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare. Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of W.P.No.18807 of 2008 & batch vide Common Order dated 08.07.2013.

In this case also, it is the case of the petitioner that he has completed Engineering course and as on today, the certificate of the petitioner was not cancelled.

The aforesaid submissions of the learned counsel for the petitioner have not been disputed by the learned Assistant Government Pleader for Social Welfare.

In view the facts and circumstances, for the reasons alike in the Common Order dated 08.07.2013 in WP No.18807 of 2008 & batch, the competent authority under the Andhra Pradesh (SC, ST

& BC) Regulation of Issue of Community Certificates Act, 1993 is at liberty to take appropriate steps, if so, advised, for canceling the community certificate issued to the petitioner in the writ petition, writ petition is disposed of directing the respondents to give effect to the Caste Certificate produced by the petitioner, till it is cancelled in accordance with law. No costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand disposed of. _________________________ A.RAJASHEKER REDDY,J 15-06-2017 kvs
