This is an application filed under Sections 10 to 12 of the Contempt of Courts Act, 1971 alleging wilful disobedience of the orders of this Court dated 11.04.2016 passed in W.P.No.23360 of 2014.

Heard the learned counsel for the petitioners and the learned Government Pleader.

In the main writ petition challenge is to the award dated 15.07.2013 passed by the Labour Court, Godavarikhani in I.D.No.44 of 2009. This Court, while ordering Rule Nisi on 11.04.2016 in WPMP.No.29262 of 2014, granted interim suspension of the award dated 15.07.2013 passed by the Labour Court in I.D.No.44 of 2009 subject to the writ petitioners depositing half of the amount awarded within a period of eight weeks from the date of receipt of the order and with a permission to the respondents to withdraw the same on such deposit. According to the learned counsel for the petitioners, despite the orders of this Court to deposit the amounts within a period of eight weeks, the respondents in the writ petition/petitioners herein have not deposited the amount as directed by this Court. 4.

On the other hand, it is submitted by the learned Government Pleader that this Court granted interim suspension order subject to the condition of depositing half of amounts awarded by the Labour Court within eight weeks and in the event of any default committed in depositing the amount, it is open for the respondents herein to execute the award and the present contempt case is not maintainable.

Since this Court granted interim order on condition of depositing half of the amount awarded and as the respondents/writ petitioners herein have not deposited the amount, according to the petitioners, it is open for the respondents/petitioners in the contempt case to seek execution of the award. 6.

With the above observations, the Contempt Case is closed. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
