Writ Petition No. 6689 of 2017 is filed by the petitioners seeking a direction in the nature of Writ of Mandamus declaring the action of the official respondents 3 to 6 in allowing the respondents 7 & 8 in converting the agricultural lands situated at R.S.Nos. 580, 580/A2, 581, 569, 583, 586, 582 of Kadali Village, Razole Mandal, East Godavari District into fresh water aquaculture ponds as illegal and arbitrary and violative of provisions of G.O.Ms.No. 7, Animal Husbandry and Dairy Development and Fisheries (Fish.II) Department dated 16.3.2013 and consequently direct the official respondents to stop respondent Nos. 7 & 8 from converting the agriculture lands into fresh water aquaculture ponds. Whereas the 7th respondent in the above Writ Petition filed Writ Petition No.

19639 of 2017 seeking Writ of Mandamus declaring the inaction of the respondents in granting 'Final Registration Certificate' for fresh water aquaculture in respect of the lands situated in S.Nos. 569, 580, 581 and 582 in Kadali Village, Rozole Mandal, East Godavari District, as illegal arbitrary and unjust and consequently direct the second and third respondents to grant Final Registration Certificate.

When the matter came up for hearing before admission, both the learned counsel Sir L.V.S.Nagaraju and Sri N. Siva Reddy and also the Government Pleader for Fisheries would submit that the District Collector/Chairman, District Level Committee for Fresh Water Aquaculture, East Godavari District, who is third respondent in W.P.No. 6689 of 2017 and second respondent in W.P.No. 19639 of 2017, is the appropriate authority to pass the necessary order in respect of the grievances of both the writ petitioners.

In that view, both the writ petitioners are at liberty to appear before the District Collector/ Chairman, District Level Committee and submit their case and in which event, the said authority shall pass appropriate order on merits within four weeks from the date of receipt of a copy of this order.
