HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PAPPEAL No.186 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Mr.Vedula Venkataramana, learned Senior Counsel for the appellant, Mr.A.Sudershan Reddy, learned Senior Counsel for respondent No.1 and Mr.A.Jagan, learned counsel for respondent Nos.3 to 5 (respondent Nos.2 to 4 in W.P.No.37923 of 2015). Mr.A.Jagan, on instructions, submits that respondent Nos.3 to 5 have already commenced the process for inviting tenders for the next one year commencing from 01.04.2016 and he submits that they shall complete the process and award the contract. His statement is recorded and accepted.

In view thereof, Mr.Vedula Venkataramana, submits that if the directions are issued to respondent Nos.3 to 5 to complete the tender process on or before 31.03.2016, he has instructions not to press this writ appeal and he seeks liberty to the appellant to participate in the fresh tender process.

In the circumstances, we are satisfied that the following order shall meet the ends of justice:

"Respondent Nos.3 to 5 are directed to complete the tender

process for the next one year commencing from 01.04.2016 on or before 31.03.2016 and award the contract from 01.04.2016. It is open to the appellant and other similarly placed transport contractors to participate in the tender process subject to fulfilment of all terms and conditions that will be stipulated in the tender notification." With these observations, the writ appeal is disposed of as not pressed.

Consequently, miscellaneous petitions, if any, also stand disposed of.
