HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.259 of 2016 ORDER:

This petition is filed to withdraw FCMOP 26 of 2015 from the file of Additional District Judge-cum-Family Court, Srikakulam and transfer the same to Family Court, Vizianagaram.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 19.08.2014 at her parents' house as per Hindu rites and caste custom and she joined respondent and that she was driven out from the matrimonial home without any reason, therefore, she was constrained to file OP before the Family Court, Vizianagaram seeking restitution of conjugal rites. She stated that respondent in order to harass her filed FCOP No.26 of 2015 before the Family Court, Srikakulam seeking divorce on false and untenable allegations. She stated that she being women, it is difficult for her to travel from Vizianagaram to Srikakulam to defend O.P.No.26 of 2015, as she filed O.P for restitution of conjugal rights before Family Court, Vizianagaram, it would be appropriate to transfer FCOP No.26 of 2015 to Family Court, Srikakulam.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner. Perused the affidavit filed in support of the petition.

5. Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of the wife, O.P.No.26 of 2015 is withdrawn from the file of Additional

District-cum-Family Court, Srikakulam and transferred to Family Court, Vizianagaram for disposal in accordance with law.
