This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner seeking anticipatory bail in connection with FIR No.469 of 2025 of Jubilee Hills Police Station, Hyderabad District. The offences alleged against the accused are under Sections 409, 417, 419,
- 2 - 467, 120(B) of Indian Penal Code, Section 66(C) of I.T.Act and later Section 420 of IPC was added.

The case of the prosecution is that the defacto complainant lodged a complaint before police on 13.07.2025 stating that on 14.06.2022 he was admitted in Lohith Sai Hospital at Siddipet for surgery. On 16.06.2022 he underwent first surgery and on 18.09.2022, he underwent second surgery and incurred an amount of Rs.1,10,000/-. Thereafter he applied for CM.Relief Fund and met one M.Satish who is close to the former health Minister. In March 2023 the complainant along with Satish went to the Minister's office and gave an application. Later he came to know that under CM Relief Fund the complainant was sanctioned Rs.45,000/-, but the cheque was mis-appropriated by one Naresh who works in the Minister's office and others. As such, he requested the police to take necessary action against the accused basing on which police registered the case against the accused for the above offences.

Heard Sri Junnu Raghu, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and the investigating officer produced a list of fake beneficiary account holders in whose name amounts were transferred by the accused. The petitioner was deceived by A.4 as a channel to withdraw the amount. The petitioner has no role in this case as such, prayed this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that during the course of investigation, the petitioner herein is added as A.7 as the amount was credited to the his account. The petitioner herein acted as beneficiary facilitating encashment of CM Relief fund amounts deposited into their accounts. Investigation is not yet completed and if bail is granted, the petitioner may tamper the evidence. As such, prayed to dismiss this petition.

Considering the submissions made and the material on record, the petitioner herein is working as sweeper on contract
- 4 - basis in the said office and A.4 took his account number. Though amount is credited to his account, immediately, he transferred the same to A.4 account and petitioner also filed his bank statement showing the same. The only amount petitioner has received is Rs.2000/- and that he is not aware of the alleged offence and the conspiracy of other accused. Considering the employment of petitioner and also allegation against this petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions :
i.
The petitioner/A.7 shall surrender before the Station House Officer, Jubilee Hills Police Station, Hyderabad within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner/A.7 on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.
ii.
The petitioner/A.7 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioner/A.7 shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
