W.P.No.6965/2017 THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN THE HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION No.7644 of 2017 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) Aggrieved by the action of the 1st respondent in blocking the way bills and other statutory forms, the petitioner has come up with the above writ petition.

2. Heard Mr. G. Narendra Cheety, learned counsel for the petitioner and Mr. Shaik Jeelani Basha, learned counsel appearing for the respondents.

3. The way bills are blocked purportedly on account of the nonpayment of the tax as per the assessment order dated 26.11.2016. But as against the said order, the petitioner has filed an appeal before the Appellate Deputy Commissioner (CT) on 10.02.2017. Today, it is stated that the arguments in the said appeal were already heard on 16.03.2017 and the judgment reserved.

4. In such circumstances blocking the way bills and other statutory forms, except paralyzing the business, would not achieve any other purpose. Therefore, the writ petition is allowed directing the respondents to unblock the way bills and other statutory forms to the petitioner. It is needless to point out that after the appeal is disposed of it is always open to both the parties to work out their remedies in accordance with law.

4. As a sequel, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
