THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CIVIL REVISION PETITION No.5412 of 2018 O R D E R:

This Civil Revision Petition is filed challenging the Docket Order dt.28.08.2018 in I.A.No.564 of 2018 in O.S.No.102 of 2017 of the V Additional District Judge, Tirupathi seeking advancement of the date of hearing of the suit from 02.02.2019 to an early date on the ground that petitioners 1, 3 & 4 are senior citizens.

The Court below dismissed the said application stating that the suit is of the year 2017 and since there are pre-2014 matters, the Court is not in a position to take up the instant case immediately.

Challenging the same, this Civil Revision Petition is filed.

Though counsel for petitioner sought to contend that the Court below ought to have advanced the suit as sought by the petitioner, I do not see any error of jurisdiction in the order passed by the Court below declining advancement of the instant suit, which is filed in the year 2017 when there are several pre-2014 matters and probably in those matters also there are persons who are senior citizens or who might have become senior citizens.

Therefore, this Civil Revision Petition is dismissed. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
