This writ petition is filed with the following prayer: "........ to issue a Writ, order or orders more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent in issuing the tender notification dated 17-08-2012 incorporating highly oppressive and arbitrary conditions in Rc.No.Plng.1/233/2012/LC, during the subsistence of the contract with the petitioner Society as arbitrary, contrary to the G.O.Ms.No.398, dated 16-09-1990 and contrary to the principles of natural justice and Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondent to award the work to the petitioner-society in terms of the aforesaid G.O.and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

This Court granted interim order on 11-09-2012. Admittedly, tender was issued for granting lease for a period of two years. It is stated that the petitioner was granted lease in pursuance to the interim orders. In view of the same, the cause in the writ petition does not survive for adjudication and the same has become infructuous.

Accordingly, this writ petition is dismissed as infructuous. However, this will not effect if the petitioner is granted lease pursuant to fresh tender notification.
