THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION (TR) No.487 OF 2017 ORDER:
The petitioners are stated to be working as Extension Officers in the respective places. A seniority list of Extension Officers of Zone VI was also prepared. They state that they are eligible and qualified for promotion to the Divisional Panchayat Officers as per Rules. It is the case of the petitioners that unofficial respondents were promoted to the Post of Mandal Parishad Development Officers in the existing vacancies from the feeder category of Extension Officers and they have joined their respective posts also. Their pay was also fixed. While so, when the first respondent issued a Memo on 15.04.2013 requesting the District Panchyat Officers to furnish the information of Extension Officers (PR&RD) in the prescribed check list along with ACRs/Special Assessment Reports for the past five years, the present writ petition was filed. The impugned Memo reads as follows.
"The attention of all the District Panchayat Officers in the State are invited to the subject cited and requested to furnish the information of EO (PR&RD) in the prescribed check list (enclosed), along with ACRs/Special Assessment Reports for the past (5) years of the individuals listed in the Annexures - I & II". A reading of the above Memo clearly shows that it is a communication issued to the District Pancyhayat Officer calling for information of Extension Officers (PR&RD) for the purpose of filling up of the post of Divisional Panchayat Officers in the State as the Extension Officers are stated to be the feeder category. Such communication cannot be challenged and it does not create any cause of action.
The writ petition is accordingly dismissed. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
