The Land Acquisition Officer / Revenue Divisional Officer, v. Jala Indra Reddy

THE HONBLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HONBLE SRI JUSTICE A.SHANKAR NARAYANA L.A.A.S.Nos.137, 145 and 146 of 2010 Common Judgment: (Per the Hon'ble Sri Justice V Ramasubramanian) These three appeals are filed by the Land Acquisition Officer questioning the enhancement of compensation granted by the reference Court from Rs.2,50,000/- per acre to Rs.27,29,760/- per acre. Heard the learned Government Pleader for Appeals for the appellant and Mr. M. Venkat Ram Reddy, learned counsel for the respondents.

It is admitted even by the learned Government Pleader that the lands covered by the very same notification and of the very same type and nature, were awarded similar enhancement by the reference Court in O.P.No.9 of 2005 and that the award passed by the reference Court was also confirmed by a Division Bench of this Court in L.A.A.S.No.97 of 2010 and Cross Objections (SR) No.11864 of 2010, by order dated 24.09.2014 and that following the said order, a batch of appeals in L.A.A.S.Nos. 99, 134, 138, 139, 140, 142, 144 and 172 of 2010 were dismissed by order dated 27.02.2015. In essence, the issues raised in these appeals, are already answered against the appellant in other appeals.

Hence, following the judgments of another Division Bench of this Court dated 24.09.2014 and 27.02.2015, these appeals are dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
