THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.15058 of 2025 ORDER:

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.1 seeking enlargement on bail in connection with FIR No.236 of 2025 of Kesamudram Police Station, Mahabubabad District. The offences alleged against the petitioner are under Section 80 (2), 85, 115(2) of Bharatiya Nyaya Sanhita, 2023 and under Sections 3 and 4 of Dowry Prohibition Act.

The case of the prosecution is that the defacto complainant lodged a report before police stating that the marriage of deceased was performed with the petitioner in the year 2021 by giving Rs.10 lakhs cash and 7 tulas of gold as dowry and they were blessed with a male child. After the birth of the child, the petitioner started harassing the deceased physically and mentally for want of additional dowry of Rs.5 Lakhs and due to the unbearable harassment of petitioner, the deceased committed suicide on 13.09.2025 by consuming rat

poison. Hence, requested the police to take necessary action against the accused, basing on which the police registered the case against the accused for the above offences. 3.

Heard Sri B. Balaji, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is falsely implicated in this case. The petitioner also committed suicide on the day when the deceased consumed poison in view of illhealth of his child. The petitioner is in jail from 10.10.2025. He further submitted that the father of petitioner died on 20.11.2025 and he has to perform the funeral of his father. As such, prayed this Court to grant regular bail by allowing this petition.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioner are severe in nature. There is a suicide video recorded by the deceased wherein she clearly stated about the harassment meted out by her in the hands of petitioner and that due to the

said harassment she committed suicide. However, he reported no objection for granting interim bail to the petitioner. 6.

Considering the submissions made and the material on record, in view of the death of the father of petitioner, as he has to perform the funerals, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/A.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Mahabubabad.

ii.

The petitioner/A.1 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday and Saturday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.1 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
