This Criminal Petition is filed praying this Court to enlarge the petitioners on bail who are arrayed as accused in Crime No.30 of 2025 before the KPHB Colony Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 143 and 144 of BNS and Sections 3, 4 and 5 of PIT Act.

The brief facts of the case are that on 27.10.2025, the SubInspector of Police, KPHB, received credible information about prostitution at Flagship Oyo Hotel in Sardar Patel Nagar. She formed a
team with mediators and women staff, conducted a raid, and allegedly found four men and two women involved in prostitution in Rooms 203 and 205. The police claimed that one Padala Jai Chandra and the receptionist Sai Kiran were organizing the activity by booking rooms, collecting money from customers, and paying the women. The police seized cash, mobile phones, condoms, and a DVR and registered the Crime for the above said offences.

Heard Sri G. Mallesha, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners had been falsely implicated, as petitioner No.1 was merely a customer staying at the hotel and petitioner No.2 was only a receptionist performing routine duties of room allotment. He further submitted that the police acted in a mechanical manner for statistical purposes and attributed the role of organizers to the petitioners without any supporting material. He contended that investigation was substantially completed, statements of the witnesses were already recorded, and no purpose would be served by continued detention. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners
stating that the there are serious allegations against the petitioners. Further, the investigation was not yet completed. At this stage, granting of bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions made, and on perusing the material placed on record, it is noted that the petitioners have been in judicial custody since 28.10.2025. The investigation appears to have progressed substantially, with statements of witnesses recorded and material evidence seized. At this stage, it can be observed that the apprehension of the prosecution can be met by imposing suitable conditions to ensure the presence of the petitioners and their cooperation with the investigation. Therefore, this Court is inclined to enlarge the petitioners on bail subject to the following conditions: i. The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the IV AJCJ cum XV Additional Metropolitan Magistrate, at Kukatpally, Cyberabad.
ii. The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for
the purpose of investigation, and thereafter, as and when required.
iii. The petitioners shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.
