THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 9903 OF 2018 ORDER:

This criminal petition is filed under Section 482 of the Code of Criminal Procedure (for short, "Cr.P.C.") by the petitioner-accused to quash the proceedings against him in C.C.No. 166 of 2018 on the file of the Court of Judicial I Class Magistrate, Punganur (for short, 'the Court below'). 2.

At the hearing, without touching the merits of the case, learned counsel for the petitioner has requested this Court to issue necessary direction to the Court below to re-call the non-bailable warrant issued against the petitioner on the same day on his appearance.

In view of the innocuous request made by learned counsel for the petitioner, the petitioner is permitted to file an application under Section 70 (2) of Cr.P.C. before the Court below to re-call the non-bailable warrant issued against him and on filing such application, the Court below is directed to dispose of it on the same day on appearance of the petitioner in accordance with law. 4.

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
