THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37166 of 2012 ORDER:

This Writ Petition is filed for the following relief: "For the reasons disclosed in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a writ order or direction in the nature of Mandamus or otherwise declaring the action of the first, second and third respondents in interfering with the day to day activities of the petitioner club and threatening the office bearers and members of the petitioner club to implicate in a false case in the event of allowing the members of the petitioner club to pay 13 cards Rummy as arbitrary, illegal, unconstitutional violating Article 14, 21 of the Constitution of India issuing consequential directing them not to interfere with the activities of the petitioner club and not to implicate members of the petitioners club, officer bearers of the petitioners club in any false cases, for allowing the members of the petitioners club playing 13 card Rummy and further direct the other respondents 4, 5, 6, 7 to conduct enquiry and take appropriate action on the 8th respondent and pass such other order or orders as it deems fit and proper."

When the matter is called today, it is submitted by the learned counsel for the petitioner that subject matter of the Writ Petition is squarely covered by the order of this Court in Writ Petition Nos.30597 of 2014 and 22428 and 121 of 2015, dated 29.10.2015 and a copy of the same is placed on record.

Following the said order and for the reasons recorded therein, this Writ Petition is also disposed of with the following order:

1.

Directing the respondent police authorities not to interfere with the card game of rummy (13 card game) whatever be the stakes;

2.

Directing the petitioner to install video cameras and record the entire recreational activities in the club and preserve the said data at least for a period of fortnight so that the police can check the footage. The said C.C cameras shall be connected with the jurisdictional police stations and the Office of the Superintendent of Police for observation by the police to find out as to whether members of the club are indulging in the activity of gambling. If any of the gaming places is not covered by C.C cameras, it is for the police to take action.

Declaring that the police are entitled to enter into the premises of the petitioner's club for taking action as per law in the event of there being any violation of the provisions of law by the petitioner and the petitioner shall not cause any hindrance to the police in exercising their statutory powers; and 4.

Declaring that this order would not come in the way of the respondents from taking action as per law.

Declaring that any deviation of the above guidelines by the petitioner's club will be construed as violation of this order.

Consequently, Miscellaneous Petitions, if any pending in this Writ Petition shall stand disposed of. No order as to costs. _________________
