THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.28674 of 2011 ORDER:

The grievance of the petitioners in this case was that the police authorities were not giving due protection to their lives and property.

The claim of the petitioners for such protection was pursuant to the order passed in the execution proceedings arising out of the judgment and decree passed by the learned Principal Junior civil Judge, Puttur, in O.S.No.95 of 2008. However, it appears that the respondents herein filed an application for setting aside the ex parte judgment and decree passed in the suit and the said application, being I.A.No.526 of 2010 in O.S.No.95 of 2008 on the file of the learned Principal Junior Civil Judge, Puttur, was allowed on 10.02.2012. As the suit proceedings were restored, the order passed in the execution proceedings directing the police to give protection to the petitioners ceased to be operative. The prayer of the petitioners in this case cannot therefore be accepted.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
