THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.22234 OF 2016 ORDER:

The communication dated 05.07.2016 of the Appellate Committee of the University not acceding to the request of the petitioners with respect to affiliation is challenged before this Court. One of the grounds on which the challenge is made is that though the petitioners have filed an appeal, in the references mentioned in impugned order it has been stated that no on-line appeal has been submitted. However, the e-mail communication dated 11.06.2016 of the University discloses that 1st petitioner's appeal is in place and the petitioner was directed to attend personal hearing before the Appellate Committee on 11.06.2016. The communication also specifically points out compliance/re-verification with respect to fulfillment of the deficiency of petitioner in not having Principal and faculty.

When this is pointed out, learned counsel for the University submitted that a direction may be given to the University to re-consider the material placed on record including appointment of the Principal so as to enable the University to take appropriate action. The submission made by the learned counsel for the University is fair. Accordingly, the matter is remitted back to the University to consider the material uploaded by the petitioners and on examination of the same if the University is satisfied with respect to the fulfillment of deficiencies, the University shall take necessary steps for including the name of petitioners-Colleges in the web counseling for the academic year 2016-17.

Learned counsel for the University shall inform the authorities of University the decision of this Court.

Accordingly, the Writ Petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
