THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.34876 OF 2012 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue an Order, Direction, or Writ more in the nature of WRIT OF MANDAMUS declaring the action of respondents 1 and 2 in interfering in the civil dispute in O.S.No. 209 of 2012 on the file of the Court of the Principal Junior Civil Judge, Huzurabad, Karimnagar District pending between brothers of petitioner and 3rd respondent as bad, illegal, arbitrary and opposed to principles of natural justice, in violation of Art.14 and 21 Constitution of India and to set aside the same consequently directing the respondents 1 and 2 not to interfere in the civil dispute and be pleased to pass such other order or orders."
2. Heard Sri C.Ramesh Sagar, learned counsel, appearing for the petitioner and learned Government Pleader for Home, appearing for the respondents.
3. A counter affidavit is filed by the Sub-Inspector of Police, Veenavanka Police Station, Karimanagar District - 2nd respondent, wherein at Paragraph No.9, it is stated that he never interfered with the civil disputes and the subject lands of the petitioner.
4. While referring to the same, it is submitted by the learned counsel for petitioner that the said averments made at Paragraph No.9 of the counter may be placed on record and writ petition can be disposed of.
5. In view of the above, writ petition stands disposed of, by placing on record the averments made at Paragraph No.9 of the counter affidavit filed by the Sub-Inspector of Police, Veenavanka Police Station, Karimanagar District - 2nd respondent.
6. Miscellaneous petitions pending consideration, if any, in the Writ
