THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.15161 of 2025 ORDER:

This criminal petition is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/accused Nos.2 to 8 seeking enlargement on bail in connection with Crime No.213 of 2025 of Narayanpur Police Station, Yadadri-Bhongir District, registered for the offences punishable under Sections 111(2)(ii), 111(3)(4), 112(2) of the BNS and Section 9(1) of the TS Gaming Act.

The case of the prosecution is that on credible information the police conducted inspection on 01.11.2025 and found accused Nos.1 to 8 were indulged in betting amount by playing a band game i.e. three cards, as such, they reported the same to the concerned authority. Basing on the same, police registered the case against the accused for the above said offences.

Heard Smt. Annapurna Sreeram, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioners is that the petitioners are innocent of the said allegations and they are in jail from the last 25 days and the accused No.1 was already protected with 35(3) notice by this Court. Hence, requested this Court to grant bail to the petitioners. 5.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the petitioners are habitual offenders and each accused is involved in more than five crimes from the year 2012 and they are not the native of this state, they are from different states and the cases against them were registered in different police stations. Therefore, he prayed this Court to dismiss this petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioners are in jail from 01.11.2025 and with the same crime, accused No.1 is

protected with 35(3) notice. Considering the facts and circumstances of the case and the incarceration period of the petitioners, this Court deems it fit to grant bail to the petitioners/accused Nos.2 to 8, subject to the following conditions:

i.

The petitioners/accused Nos.2 to 8 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Choutuppal.

ii.

The petitioners/accused Nos.2 to 8 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners/accused Nos.2 to 8 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
