THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14121 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.2 seeking bail in crime No.90 of 2015 on the file of the Kotavuratla Police Station, Visakhapatnam, registered for the offences under Sections 420, 468, 409 and 471 IPC read with Section 34 IPC.

Heard and perused.

The allegation against the petitioners is that the first petitioner, being the Village Revenue Officer and the second petitioner, created duplicate pattadar pass books and forged the signatures of the original pattadars and by using the said forged documents, availed loans from the bank and that the petitioners have not repaid even a single loan. Learned counsel for the petitioners submits that the petitioners have not committed any offence and they have been falsely implicated in the crime and as such, he prays this Court to grant bail to the petitioners herein.

Considering the facts and circumstances of the case, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioners/A.1 and A.2 herein.

The criminal petition is accordingly dismissed. _____________________ JUSTICE RAJA ELANGO 06.01.2016 pln
