THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.17255 of 2017 ORDER :

In this writ petition, the petitioners challenged the Eviction Notice dated 24.04.2017 issued by the 4th respondent under Section 7 of the A.P. Land Encroachment Act, 1905 in proposing to evict them from the land in an extent of Acs.6.12 guntas in Sy.No.298/1 of Gudur Village fields, Gudur Mandal, Mahabubnagar District.

Heard learned counsel for the petitioners and perused the material available on record.

Normally, this Court will not interfere at the stage of show cause notice. Therefore, this Court is not inclined to interfere with the impugned show cause notice dated 24.04.2017 issued by the 4th respondent. However, it is open for the petitioners to submit explanation to the said show cause notice within a period of four weeks from the date of receipt of a copy of this order. On receipt of such explanation from the petitioners, the 4th respondent is directed to consider the same and pass appropriate orders in accordance with law, after affording an opportunity of being heard to the petitioners. Till passing of such orders, there shall be status quo with regard to the possession of the petitioners from the subject land.

Subject to the above direction, this writ petition is disposed of, at the admission stage.

As a sequel,

ARR,J W.P.No.17255 of 2017 miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
