THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27504 of 2017 O R D E R:

Petitioner is running fair price shop No.17 of Kajavaripalem Village, Duggirala Mandal, Guntur District, on temporary basis. It is her case that on an earlier occasion, when a notification was issued for appointment of fair price shop dealer for the above stated shop on permanent basis, she filed W.P.No.25463 of 2017 and this Court vide order, dated 01.08.2017, disposed of the same by directing the authorities to consider her case in accordance with law. Thereupon, the claim of the petitioner was rejected by respondent No.4 vide endorsement, dated 31.07.2017, on the ground that she has not passed SSC qualification. As on today, she possessed SSC qualification. In view of the same, she filed the present writ petition seeking to quash the said endorsement and to consider her case to be appointed as a permanent fair price shop dealer in respect of the aforesaid shop. The petitioner asserts that she is a member of DWACRA Group and she is having experience in running the fair price shop.

Heard learned counsel for the petitioner.

Learned Government Pleader for Civil Supplies, on instructions, submits that the petitioner is a married woman and

was over-aged and that as the appointment on compassionate grounds is restricted to an unmarried daughter in terms of Clause 6 (2) of G.O.Ms.No.4, dated 28.02.2014, rejection of the candidature of the petitioner cannot be found fault with. The facts are not in dispute. The ineligibility of the petitioner is evident from the fact that the petitioner is aged about 44 years. Further, the petitioner is a married woman and in terms of the above said G.O., compassionate appointment is restricted to only unmarried daughters.

In those circumstances, there is no merit in the writ petition, which is accordingly dismissed.
