HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20796 of 2017 ORDER:

This Writ petition is filed under Article 227 of the Constitution of India for the following relief: "...to issue a writ or order more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the inaction of the 2nd respondent in passing the orders on the stay application filed along with an appeal dated 15.06.2017, aggrieved by the proceedings in R.C.C. No.476/ 2017, dated 08.06.2017 passed by the 3rd respondent where under the authorization of the petitioner shop No.3, Pullala Cheruvu Village & Mandal, Prakasam Dsitrict, was cancelled without conducting an enquiry is illegal, arbitrary and unconstitutional and consequently set-aside the proceedings dated 08.06.2017 of the 3rd respondent and direct the respondents 3 and 4 to continue the petitioner as a fair price dealer and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

2) Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies representing respondents 1 to 4 and perused the prayer in the writ petition with the supporting affidavit and other material on record. 3) Pending enquiry, the impugned suspension was passed by the primary authority i.e., Revenue Divisional Officer, Markapuram on 08.06.2017. An appeal was filed before the Collector (CS) against such order on 15.06.2017. By complaining that the same is not disposed of, the writ petition is filed on 23.06.2017.

Dr. SSRB,J WP_20796_2017 4) Instead of observing anything, this Court feels it just to direct the said appellate authority i.e., Collector (CS), to dispose of the said appeal within four weeks from the date of receipt of copy of this order.

5) Accordingly and in the result, the writ petition is disposed of.

6) Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
