THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26195 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner states that he is the owner of the lorry bearing No.AP 29 V 0369 which was purchased on 29.01.2008. While so, the third respondent seized the said vehicle and registered a case in Crime No.69/2017 under Section 420 IPC read with Section 7 of the Essential Commodities Act. The third respondent seized the said vehicle along with the rice, which was being transported on hire basis.

Learned Government Pleader for the respondents submits that now proceedings under Section 6A of the Essential Commodities Act are pending before the second respondent and the second respondent is the competent authority for release of the vehicle. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit an application for release of the vehicle before the second respondent. After receipt of the said application, the second respondent shall consider release of the vehicle, subject to the terms and conditions imposed by him, within a period of one week thereafter. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
