THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.25360 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue an appropriate Writ, Order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents 2 and 3 in not extending the agreement for de-casting of sand from the patta land admeasuring Ac.8.50 gts in Sy.No.13/3 of Chinturu Village, Wazeedu Mandal, Erstwhile at Khammam District (now at Jayashankar Bhupalapally District) though agreement dated 21.11.2016 to de-cast sand is in force till 21.11.2017 and pass such other orders as may deem fit and proper in the circumstances of the case."

Heard learned counsel appearing for the petitioner, Sri V.Pratap Reddy, learned Standing counsel appearing for respondent No.3 and learned Government Pleader for respondents 1, 2, 4 and 5, apart from perusing the material available on record. 3.

When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 17.04.2017 to the 4th respondent herein and no orders have been passed on the said representation so far and a copy of the same is also placed on record. It is also submitted by the learned counsel that copies of said representation were also submitted to respondents 2 and 3. It is further requested by the learned counsel that necessary direction may be issued to the respondents

AVSS,J W.P.No.25360 of 2017 2 and 3 to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe. The said request is not opposed.

It is submitted by the learned Government Pleader appearing for respondents 1, 2, 4 and 5 that appropriate action will be taken, on the said representation.

Recording the said submission, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the respondents 2 to 4 herein to consider and pass appropriate orders on the representation dated 17.04.2017 said to have been submitted by the petitioner herein, in accordance with law, within a period of three (03) weeks from the date of receipt of a copy of this order. 5.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
