This Criminal Petition is filed under Sec.437 and 439 of Cr.P.C. seeking bail for the petitoner/A8 in Cr.No.234 of 2014 of Tada Police Station, Nellore District (in connection with SC No.110/2015 on the file of the VII Additional District and Sessions Judge, Gudur), registered for the offences under sections 419, 420, 363, 395, 342, 489 and 201 IPC.

Heard both sides. Perused the records.

The petitioner is A4. The case of the prosecution is that on the intervening night of 24/25.11.2014 at 1.00 a.m when the victims who are driver and cleaner of mini-lorry bearing No.MP09-GF8692 were proceeding from Indore to Chennai with chocolates load and when they reached to near petrol bunk, Periyavattu village, Tada Mandal, the accused came in a Scorpio vehicle, stopped their lorry stating that they are Sales Tax Officers and demanded to show papers, when the victims got down the vehicle, the accused caught hold of them and forced them to sit in their Scorpio, tied their hands and legs and took their cell phones, threatened them with knives, and took them in their Scorpio to some distance and thereafter threw them in the dark place, committed dacoit of goods in the lorry, and taken away their lorry.

After investigation, the police filed charge sheet. The contents of the charge sheet would show that during course of investigation on 25.02.2015 arrested A1 to A5 at B.V.Palem Integrated check post and seized the crime vehicle i.e.

A1 to A5.

Since there are specific allegations made against the petitioner/A4, and as the offence is serious in nature, I feel that it is not a fit case where bail can be granted.

The Criminal Petition is accordingly dismissed. Pending miscellaneous applications, if any, shall stand closed in consequence.
