THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11587 of 2015 ORDER:
This Criminal Petition is filed by the petitioner-accused No.2 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.160 of 2014 on the file of Piler Police Station, Chittoor District, registered for the offence punishable under Sections 302, 201 and 120-B r/w 34 IPC.
Heard and perused the material available on record. It is alleged that A1 to A4 followed deceased Nos.1 and 2, who were going on a motor cycle, in a car, hit the motor cycle and attacked the deceased 1 and 2, with hunting sickles and hacked on the face, hands and head of the deceased No.1 and hacked on the face, head of deceased No.2 as a result of which, deceased No.1 died on the spot and deceased No.2 died in the hospital while undergoing treatment. Learned Counsel for the petitioner submitted that A1 caused injuries to both the deceased and basing on the confession statement made by A1, the petitioner was arrayed as accused and the petitioner was arrested and he has been in prison since 12.10.2015.
Learned Public Prosecutor submitted that the investigation is at the initial stage.
Considering the facts and circumstances of the case and the gravity of the offence, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the criminal Petition is dismissed. _____________________ JUSTICE RAJA ELANGO Dated: 17.11.2015 Nn
