wp_32788_2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for the following substantive relief: "For all the reasons stated above, it is prayed that this Hon'ble Court may be pleased to issue an appropriate order or direction more particularly a writ of certiorari calling for the records pertaining to the orders passed by the Hon'ble A.P. Administrative Tribunal in O.A.No. 2576 of 2017, dated 07-09-2017 in dismissing the O.A. and the article of charges issued by the 2nd respondent vide memorandum Rc.No. A6/PR-23/2017, dated 28-08-2017 basing on the letter addressed by the 3rd respondent on 03-06-2017 and on the alleged preliminary enquiry report submitted by the Assistant Commandant on 12-06-2017 who is subordinate to the 3rd respondent and quash the same by declaring the same as illegal, arbitrary, abuse of process of law, violation of principles of natural justice, contrary to the rules in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." 2.
After arguing the case, Sri S.Surender Reddy, learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition without prejudice to the right of his client to defend himself in the pending disciplinary proceedings.

The Writ Petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, W.P.M.P.No. 40762 of 2017 shall stand dismissed as infructuous.
