Heard both sides.
2. This civil revision petition is filed by the revision petitioner/ defendant aggrieved by the order dated 10.04.2017 passed in IA No.241 of 2017 in OS No.157 of 2015 on the file of the Principal Junior Civil Judge, Proddatur, dismissing the petition filed by the petitioner under Section 151 CPC to direct the respondent/ plaintiff to prepare a copy of the calculation sheet in the open court, on any date fixed by the court, in terms of the calculation memo filed along with separate petition for sending the same to the handwriting expert for comparison and report.
2. When the matter came up for hearing, Mr.Nagaraju Naguru, learned counsel for the petitioner, would fairly concede the prayer in the petition was vague and that might be one of the reasons the trial court dismissed the petition. He further submits that the petitioner would file an appropriate application before the trial court seeking proper remedy to vindicate his defence and sought permission.
3. In view of the said submission, the civil revision petition is dismissed at the stage of admission, with a liberty to the petitioner to file a fresh application, subject to relevant laws applicable. No order as to costs. Miscellaneous petitions, pending if any, in this revision petition, shall stand dismissed.
