HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17354 OF 2017 ORDER:
By this writ petition, the petitioner seeks a direction for cancellation of the Gift Settlement Deed dated 28.10.2016 executed by the fifth respondent in favour of the sixth respondent. Learned counsel for the petitioner submits that the fifth respondent, having executed Registered Gift Settlement Deed dated 31.03.1995 in favour of the petitioner in respect of the subject property, which is in subsistence, has executed a Gift Settlement Deed in favour of the sixth respondent. Admittedly, the petitioner has an efficacious alternative remedy under Section 31 of the Specific Relief Act, 1963, for cancellation of the Gift Settlement Deed. This Court is therefore not inclined to entertain this writ petition. The writ petition is accordingly dismissed. It is however open for the petitioner to avail the remedy under Section 31 of the Specific Relief Act, 1963, for redressal of her grievance. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
