The petitioner assails the action of the Inspector of Police, Banjara Hills Police Station, Banjara Hills, Hyderabad, in insisting upon production of the petitioner's daughter, Smt. Shireen.
The Inspector of Police, Banjara Hills Police Station, Banjara Hills, Hyderabad, filed a counter-affidavit stating that Crime No.673 of 2011 had been registered upon the complaint made by one Mohd. Ziaullah Ahmed Iqbal under Sections 323, 427, 448 and 506 IPC on the file of the Banjara Hills Police Station, wherein the daughter of the petitioner was shown as Accused No.1. He further stated that her whereabouts were unknown till the date of the filing of the counter, while the other accused surrendered before the competent Court and obtained bail. According to him, it was only in the course of investigation in Crime No.673 of 2011, that the Investigating Officer enquired with the petitioner as to her daughter's whereabouts.
No reply affidavit was filed by the petitioner rebutting the aforestated counteraffidavit averments. Viewed thus, this Court finds no grounds to interfere in the matter. The police authorities would necessarily have to abide by the due procedure laid down by law while investigating the subject crime and the petitioner cannot object to their doing so.
The writ petition is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs. ______________________ SANJAY KUMAR, J 05th JUNE, 2015 PGS
