THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33647 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Excise, appearing for respondents 1 & 2, and the learned Government Pleader for Home appearing for 3rd respondent.

It is stated by counsel on both sides that the issue raised in this Writ Petition is covered by the order dt.20.12.2017 passed in W.P.No.43147 of 2017.

Therefore, for reasons alike, the present Writ Petition is also disposed of, directing the petitioner to make an appropriate application before the Deputy Commissioner of Prohibition and Excise, Warangal District (second respondent), enclosing thereto a Fixed Deposit Receipt for Rs.87,500/- (Rupees eighty seven thousand five hundred only), drawn in favour of the second respondent on any nationalized bank, and on such application being made by the petitioner, the subject stock afore-stated shall be given to the interim custody of the petitioner. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed.
