THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17463 OF 2017 ORDER:
The present Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of Writ of Mandamus declaring the action of respondents 1 to 4 in not issuing No-Objection Certificate for the 2nd petitioner-Institution, for change of its affiliation from Jawaharlal Nehru Technological University, Hyderabad to Osmania University, as illegal and arbitrary.
Heard the learned counsel for the petitioners, learned Government Pleader for Education for respondents 1 and 2, Sri Abhishek Reddy, learned Standing Counsel for R.3, Sri Ch.Jagannadha Rao, learned Standing Counsel for R-4 and Sri Ramakanth Reddy, learned Standing Counsel for R.5. With their consent, the Writ Petition is disposed of at the stage of admission itself.
Though various grounds are raised in the Writ Petition, the learned counsel for the petitioners would submit that though the petitioners made applications before the 3rd respondent-JNTU, State Government and also Osmaina University for issuance of No-Objection Certificate, the same are pending consideration since long time. Hence, seeks a direction to respondents to deal with their applications at the earliest.
Learned counsel for respective respondents submit that if the applications of the petitioners are still pending consideration
and if the said application satisfy all the requirements of law, the same will be dealt with in accordance with law, at the earliest. Having regard to the rival submission made, the Writ Petition is disposed of directing respondents 1 to 4 to deal with the applications submitted by the petitioners seeking change in affiliation of the University from JNTU, Hyderabad, to Osmania University, Hyderabad, as early as possible, preferably within a period of ten days from today.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
