THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6551 of 2011 ORDER:

This writ petition was filed assailing the action of the State in not considering the case of the petitioner's husband for remission of sentence.

Learned Assistant Government Pleader for Home stated that the petitioner's husband was released on parole on 07.03.2006, but did not return on the due date. He was thereafter arrested and brought back to the prison only on 13.11.2007. As he overstayed his parole by 584 days in breach of the conditions for release on parole, he was put on notice and thereafter imposed with the punishment of (1) denial of parole and furlough for three years and (2) removal of his name from the Remission Rolls permanently. This punishment was imposed by the Director General and Inspector General of Prisons and Correctional Services, Andhra Pradesh, Hyderabad, under letter No.SA3/701/2008 dated 16.04.2008.

In the light of the aforestated developments, as matters stand, the case of the petitioner's husband cannot be considered for remission of sentence.

The writ petition is therefore without merit and is accordingly dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
