HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32667 of 2017 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not removing encroachments from irrigation water tank covered by Sy.No.146 of Gundlapalem Village, Nellore Rural Mandal, SPSR Nellore District, as illegal, arbitrary and violative of the provisions of Andhra Pradesh Water, Land and Trees Act, 2002; and consequently direct the respondents to remove the encroachments and restore the said irrigation water tank.

2) The grievance of the petitioners is that though they made a representation on 06.09.2017, but till today the authorities have not taken any action on the said representation.

3) Without going into the merits of the case and having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents to consider the representation made by the petitioners seeking removal of encroachments of irrigation water tank in Sy.No.146 of Gundlapalem Village, Nellore Rural Mandal, SPSR Nellore District, in accordance with law.
