THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5015 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ of Mandamus to declare the Final order. No. M1/ 105(5,8,7)/95-MTPL, dated 10-12-1997 passed 2nd respondent herein in imposing major punishment of withholding of annual increments for a period of two (2) years which shall have the effect on future increments without conducting the departmental enquiry and without following APSRTC (CC&A) Regulations and Circular dated; 19-2-1999 is illegal, arbitrary and violation of principles of natural justice and set aside the same with all consequential benefits including restoration of increments with all attendant benefits and payment of arrears."

Heard, Sri P. Govinda Rajulu, learned counsel for the petitioner and Sri A. Ravi Babu, learned Standing Counsel for respondents.

When the matter is called, it is represented by the learned counsel for the petitioner so also the learned Standing Counsel for respondents corporation that the issue in the present Writ Petition is squarely covered by the orders of this Court in W.P.No.1224 of 2011 and batch, dated 19-11-2015. It is further submitted that the said order is confirmed by Division Bench in Writ Appeal No.117 of 2016 on 11-03-2016 and a copy of the same is also placed on record as material paper. Following the above said common order and for the reasons recorded therein, this Writ Petition is also allowed in part

directing that the impugned orders passed by the respondent authorities shall be treated as one for stoppage of annual increments without cumulative effect. It is also made clear that the petitioner herein is also not entitled for any monitory benefits. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
