This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri S GOUTHAM, Advocate for the Petitioner and Sri Jithender Rao Veeramalla, the Additional Public Prosecutor on behalf of the Respondent No.'l and none appeared for the Respondent No.2.

THE HON'BLE SMT.JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.15087 of 2025 ORDER:- 1.

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking to quash the proceedings against the petitioners/accused in D.V.C.No.33 of 2025, pending on the file of the learned Judicial Magistrate of First Class, at Korutla.

2. Heard Sri S. Goutham, learned counsel for the petitioners/accused as well as Sri Jithender Rao Veeramalla, the learned Additional Public Prosecutor appearing for the respondent No.1 -State.

When the matter is taken up for hearing, learned counsel for the petitioners has limited his arguments seeking a direction to dispense with the appearance of the petitioner before the Trial Court. 4.

The learned Additional Public Prosecutor submitted that appropriate orders may be passed.

Perused the record. The allegations leveled agalnst the petitioners/accused pertain to the offences punishable under Section 85 of BNS, Sections 3 & 4 of DP Act. D.V.C.No.33 of 2025 is L-

- E'TD, J Crlp_15087 2025 pending on the file of the learned Judicial Magistrate of First Class. Truth or otherwise of the said allegations can be brought out during the course of trial. This Court is not inclined to interfere with the jrtdicial process.

Hence, the Criminal Petition is disposed of dispensing with the presence of the petitioners/accused before the Trial Court provided that the petitioners are represented through an Advocate on every date of hearing and that they shall be present before the Trial Court whenever they are specifically required during the course of trial.
