HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.14565 of 2011 ORDER:

The inaction of the A.P. State Council for Higher Education and the Andhra University, in not taking any action on the petitioner's representation dated 10.05.2011 and 13.05.2011, is questioned in this Writ Petition, as being arbitrary and illegal.

By the aforesaid representations, the petitioner requested the respondents to take action against two degree colleges, established in Vijayanagaram (respondents 3 and 4 herein), contending that these two colleges were not within the territory of Vijayanagaram, but were conducting admissions. No interim order was passed in the Writ Petition. Nearly eleven years have elapsed since the Writ Petition was filed. It would be wholly inappropriate for us to now direct respondents 1 and 2 to consider the petitioner's representation submitted nearly seven years ago in the year 2011. Suffice it to make it clear that, if the petitioner is still aggrieved, this order shall not disable them from submitting a representation afresh to respondents 1 and 2.

We have no reason to doubt that, if any illegalities are pointed out by the petitioner, in their representation, regarding the manner in which respondents 3 and 4 are running these colleges, respondents 1 and 2 shall take necessary action in accordance with law. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs. _______________________________ RAMESH RANGANATHAN, ACJ Date: 09.02.
