HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 45835 of 2016 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.
2) The present writ petition came to be filed with the following prayer:
" issue a writ of mandamus declaring the action of respondents 1 to 5 in circulating the list to the 6th respondent under Section 22A (1) (c) of Registration Act with regard to the land owned and possessed by the petitioner i.e., land to an extent of Ac.12.71 cents situated in Sy.No.1744 of Bommaiahgaripalle, Rompicherla Mandal, Chittoor District, as AWD (Government) land as illegal and arbitrary and to declare the action of the respondents in treating the said land as dotted land as illegal and arbitrary; and consequently direct the respondent to circulate the revised list to the 6th respondent."
3) Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that the petitioner may be permitted to file an application before the Committee constituted pursuant to the Full Bench Judgment of this Court in
Vinj amuri Raj agopala Chary v. St at e of A.P., and ot hers1, in which event, the same may be considered.
4) Learned Government Pleader would submit that he has no objection for the same.
5) Having regard to the above, the writ petition is disposed of directing the petitioner to make an application before the Committee constituted pursuant to the above referred Full Bench Judgment of this Court, within a period of two (02) weeks, in which event the same shall be dealt with in accordance with law, within a period of four to six weeks thereafter, after hearing the petitioner and the aggrieved persons, if any. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
