It is represented by the learned counsel for petitioner/ accused No.1 that the de facto complainant died, hence the present proceedings sought for against the calender case no way survives.

2) Recording the said submission, the Criminal Petition is closed giving liberty to petitioner to file fresh petition invoking Section 302 Cr.P.C and also by arraying representatives of de facto complainant as co-respondents to decide on own merits.
