The criminal petition is filed seeking quash of the proceedings in CC.No.545 of 2009, against the petitioners, who are A2 and A3, on the file of the V Additional Judicial Magistrate of First Class, Nellore. The offences alleged are under Section 498-A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2.

Heard the counsel for the petitioners, the counsel for the second respondent and the learned Public Prosecutor appearing for the first respondent.

The parties, together with their respective counsel, are present in the Court and submit that the parties have settled the matter in FAC.No.101 of 2015 today before a Division Bench of this Court. Hence, the parties and their respective counsel seek this Court to record the same and dispose of the matter.

On being specifically asked, both the parties confirm the aforestated submissions and the second respondent states that she has no objection for quash of the proceedings in CC.No.545 of 2009, against the petitioners, who are A2 and A3, on the file of the V Additional Judicial Magistrate of First Class, Nellore. Since, I am satisfied that the aforesaid settlement is arrived by the parties out of their free will, there is no impediment to quash the proceedings against the petitioners.

In view of the above, the criminal petition is allowed and the proceedings in CC.No.545 of 2009, against the petitioners, who are A2 and A3, on the file of the V Additional Judicial Magistrate of First Class, Nellore, are hereby quashed.
