HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33684 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents, in not taking any action on the representations dated 18.3.2017, 6.5.2018, submitted by the petitioners seeking for change of classification of the tank from Government land to patta land in respect of the tank admeasuring Ac.3.54 cents, situated at Sy.No.186 of Annavaram Village, Kollipara Mandal, Guntur District in the revenue records as well as in the web-land, as illegal and arbitrary. When the matter is taken up for hearing, learned counsel for the petitioner submits that pursuance to the notice dated 13.7.2018, issued by the 4th respondent, the petitioners appeared and submitted all the documents on 25.7.

2018 in support of their case that the above said tank belongs to the family members of the petitioners and requested the 4th respondent to take necessary action for change of classification from Government to patta land, but the 4th respondent failed to do so. Learned Government Pleader for Revenue, would submit that though the petitioners appeared before the authority, they failed to file the documentary evidence to confirm the title to the subject lands. According to her, during the course of enquiry conducted in the village, it came to light that the tank is in existing on ground for the last several decades. The title over the land in favour of the present petitioners family and it belongs to their ancestors has not been confirmed by the villagers and even neighbouring ryots.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 4th respondent-Tahsildar, to deal with the representation dated 6.5.2018, submitted by the petitioners seeking change in classification of land in Ac.3.54 cents situated at Sy.No.186 of

Annavaram Village, Kollipara Mandal, Guntur District and pass appropriate orders, in accordance with law, after giving the reasonable opportunity of hearing to the petitioner and all concerned, as early as possible preferably, within a period of three to five months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
