HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to be the owner and in possession of land to an extent of Ac.10.00 cents in Sy.No.254/13-C of H.Kottur Village, Hamsavaram Sivaru, Tuni Mandal, East Godavari district and claims to be cultivating and in possession for the last 28 years. Petitioner claims that the said land was purchased on 23.07.1990 and sale was executed in the year 2005. After purchasing the land, petitioner applied for mutation of his name in the revenue records and to issue pattadar pass books and title deeds. By endorsement dated 09.01.2013, Tahsildar refused to accept the request for mutation of his name in the revenue records and issuance of pattadar pass books and title deeds on the ground that the property belongs to Sri Sri Sri Ramulavari temple. Aggrieved thereby, petitioner preferred appeal before the Revenue Divisional Officer.

Alleging inaction on the appeal, petitioner submitted representation to the District Collector. The District Collector vide his letter dated nil.09.2016, after calling report from the Joint Collector, directed the Revenue Divisional Officer, Peddapuram to dispose of the appeal pending before him. Alleging inaction on the appeal preferred by the petitioner, this writ petition is filed.

The documents on record would disclose that appeal preferred by the petitioner is pending consideration of the Revenue Divisional Officer, Peddapuram and it appears, so far it is not disposed of.

If that is being so, the Revenue Divisional Officer (3rd respondent) is directed to pass orders on the appeal bearing file no.676/2011 by duly assigning reasons in support of his decision and communicate the decision thereon to the petitioner, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order. 4.
