Heard Mr.P.Laxma Reddy for petitioners, Assistant Government Pleader for Panchayat Raj and Mr.Narender Reddy for respondent No.4. No representation for respondents 5 and 6. After perusing the material available on record and particularly having regard to the interim order dated 22.08.2012, I am satisfied fresh notice to respondent No.7 need not be ordered. Petitioners pray for Mandamus declaring the action of respondents in interfering with the rights of agriculturists selling vegetables on every Saturday at Kaverammapet Weekly Market, Jedcherla Village and Mandal, Mahabubnagar District without recourse to law as illegal and unconstitutional. First petitioner is an Association of agriculturists/vendors of vegetables, fruits etc., at Kaverammapet. Second petitioner claims to be Secretary of the Association.

The petitioners in this writ petition complain against the unauthorized and threatened action of respondents in preventing the agriculturists from selling vegetables etc., at Kaverammapet Weekly Market, Jedcherla Village as illegal. With the assistance of learned counsel appearing for the parties, I have perused the annexures filed along with the writ petition.

On 22.08.2012, this Court directed respondents 1 to 4 not to interfere with the legitimate activities of petitioners in sale of vegetables in the said Ryot Bazar except in accordance with law until further orders.

The order granted is subsisting as on date. Inspite of service of notice, none of the respondents filed counter affidavits. On the ground of non-rebuttal of allegations in the writ affidavit particularly keeping in view the interim order subsisting from 22.08.2012, I am satisfied the writ petition can be disposed of by this order. Respondents 1 to 4 are directed not to interfere with the petitioners' selling vegetables, fruits etc., on every Saturday at Kaverammmapet Weekly Market, Jedcherla Village. The Writ Petition is disposed of accordingly. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
