THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.15599 OF 2016 ORDER:

This criminal petition, under Section 482 Cr.P.C., is filed to quash the proceedings in C.C. No.188 of 2012 pending on the file of Judicial Magistrate of First Class, Huzurnagar, on the sole ground that the petitioner was a minor or juvenile on the date of alleged occurrence i.e. on 29.01.2012 at 20.30 hours at Panchikaldinna Village, and he produced SSC certificate wherein the date of birth of the petitioner was shown as 05.05.1994. This Court, while exercising jurisdiction under Section 482 Cr.P.C., cannot quash the proceedings on the ground that the petitioner lost his right as juvenile.

However, the learned Magistrate is directed to enquire the age of the petitioner as on the date of alleged incident and take appropriate steps to separate the case against the petitioner and send it to the appropriate court as per procedure. With the above direction, the criminal petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
