HONOURABLE SRI J USTICE M.S.K . J AISWAL CRIMINAL PETITION No. 13147 of 2016 ORDER:

This Criminal Petition under Section 482 Cr.P.C. is filed seeking to direct the learned XII Additional Chief Metropolitan Magistrate, Nampally, at Hyderabad to conduct a common trial in CC.Nos.101,102,103,110 and 197 of 2015 and CC No. 94 of 2016.

Heard the learned Counsel for the petitioners and learned Additional Public Prosecutor representing the State. It is alleged that the petitioners/Accused claiming to be the employees the company in the name and style of M/s. Serene Global Services Pvt.Ltd, induced the respondents 2 to 12 to provide SAP computer professional course and collected security deposit of Rs.2,00,000/- from each of them promising them to provide employment and pay back the amount through salary. However, the petitioners/Accused failed to train up the respondents 2 to 12 and thereby failed to provide employment as agreed and accordingly deceived the Respondents 2 to 12. Thus respondents 2 to 12 lodged the complaints against the petitioners herein for the offences punishable under Sections 406, 420 read with Section 34 IPC.

Having regard to the above, the learned Counsel for the petitioners/Accused prayed that the trial Court may be directed to

conduct a common trial in the aforesaid CCs since the offences involved in all the said cases are one and the same. Since it is represented that on the complaints of Respondents 2 to 12, CC.Nos.101,102,103,110 and 197 of 2015 and CC No. 94 of 2016 have been registered, wherein identical questions have been involved, the learned XII Additional Chief Metropolitan Magistrate, at Hyderabad is directed to conduct trial in all the aforesaid CCs simultaneously and dispose of the same, on merits and in accordance with law.

Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
