THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5780 of 2017 ORDER:

In this petition filed under Sections 437 and 439 of Cr.P.C., by the petitioner/A.2 seeks regular bail in Cr.No.102 of 2017 of Adibatla Police Station, registered for the offence punishable under Section 20 (b) of NDPS Act.

The prosecution case is that on 10-5-2017 at about 1715 hours, while the police officials were conducting checking, they found two while colour bolero vehicles and on suspicion, they stopped and intercepted the vehicles and found accused A.1 to A.8 in both the vehicles and on verification of the vehicles, they found 25 bags of dried ganja in both the vehicles weighing about 100 kgs and seized the contraband and arrested the accused. Hence, the charge. Denying the allegations, the learned counsel for the petitioner mainly submitted that the accused has been in custody since 10-5-2017 and he was falsely implicated in this case. Learned Additional Public Prosecutor opposed the bail application.

As can be seen from the CD file, the presence of petitioner/A.2 was also noted in the mediators report and his confession statement. In that view of the matter and as the contraband seized is more than a commercial quantity and as Section 37 of NDPS Act is

intercepted for considering the bail application, the bail application is dismissed.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
