THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 39964 of 2015 ORDER:

The grievance of the petitioner, an accused in Crime No.147 of 2015 on the file of Visakhapatnam II Town Police Station, was that the police authorities were not filing a charge sheet with regard to the said crime but were calling him everyday to the police station and interfering with his life and liberty.

Written instructions dated 16.12.2015 were furnished by the Assistant Sub-Inspector of Police, Visakhapatnam Maharanipeta Police Station, to the Office of the learned Government Pleader for Home wherein he stated that Crime No.147 of 2015 had been registered under Sections 376 and 366-A I.P.C read with Section 5 of ITP Act and Sections 3 and 4 of POCSO Act, on the file of Visakhapatnam Maharanipeta Police Station.

After due investigation, the police found that a prima facie case was established against the petitioner and accordingly laid a charge sheet before the learned II Additional Chief Metropolitan Magistrate, Visakhapatnam vide DDR No.7976/2015 opining that the petitioner was liable to be punished under the named provisions of law. In the light of the aforestated developments, the grievance of the petitioner stands settled and no adjudication is warranted in this writ petition.

The Writ Petition is accordingly closed.

Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
