HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 3199 OF 2017 ORDER:

This Writ Petition was filed challenging the action of 3rd respondent in calling the petitioners to the Police Station in connection with Crime No. 199 of 2016 and harassing them. 2.

The learned Government Pleader on written instructions submits that the second petitioner lodged a compliant on 21.12.2016, and based on the same, a case in Crime No. 199/2016 was registered on 21.12.2016. Seven witnesses were examined and their statements were recorded. The inquest was held on 21.12.2016 over the dead body of the father of the petitioners. The Medical Officer issued post mortem examination report on 7.1.2017 and opined that the deceased died due to shock and haemorrhage due to head injuries and multiple injuries caused by heavy blunt object, and investigation is under progress. However, the allegation that the third respondent is calling the petitioners and detaining them in the police station was denied.

In view of the above facts, it is open to the Police to continue the investigation but shall not harass the petitioners and while investigating the crime, they shall follow the due process of law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
