THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 13208 of 2016 ORDER:
The grievance of the petitioner-Institution is that the second respondent, the Commissioner for Collegiate Education, Andhra Pradesh, is not taking appropriate action on the report dated 14.04.2013 submitted to him by the Regional Joint Director of Collegiate Education, Kadapa.

In the light of the order proposed to be passed by this Court, this Court does not deem it necessary to put the fourth respondent on notice as no issue is proposed to be decided on merits.

The petitioner-Institution seems to have addressed various representations seeking permission under Section 79 of the Andhra Pradesh Education Act, 1982, for taking action against the Principal of the Institution, the fourth respondent herein. The Regional Joint Director of the Collegiate Education, Kadapa, seems to have conducted an enquiry into the matter and submitted report dated 14.04.2013 to the Commissioner of Collegiate Education, Andhra Pradesh. The grievance of the petitioner is that there has been no action on the part of the Commissioner thereafter.
4. It is not open to the Commissioner of Collegiate Education, Andhra Pradesh, to keep a matter of this nature pending indefinitely. Having received a report from the Regional Joint Director of Collegiate Education in the context of the applications made by the petitioner- Institution, it is for him to apply his mind
and take a decision in the matter.

The Writ Petition is accordingly disposed of directing the Commissioner of Collegiate Education, Andhra Pradesh, the second respondent, to take appropriate action in the matter duly considering the petitioner-Institution's representations and the report dated 14.04.2013 submitted by the Regional Joint Director of Collegiate Education. This entire exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
